TO OBTAIN A MARRIAGE LICENSE
- Both people must appear before any town clerk in Massachusetts to apply for their licenses.
- Both must be 18 years of age or older. A good idea to bring your birth certificates with them when applying for the license.
- If one or both persons are under 18, a court order will be required.
- A blood test is no longer required for a marriage license.
- It is not required for either person to be a resident of Massachusettes to apply for a license.
- After the application has been made, There is a 3 day waiting period before the license can be issued. This does not, however, include the day the application is made.
- The Justice can not perform the ceremony without the marriage license.
- The couple can be married in any city or town in Massachusetts.
- The 3 day waiting period may be waived in certain cases of hardship, but it would require a court order of the disrtict court, probate court or family court.
- Following the ceremony, the Justice will provide a Marriage certificate as proof of Marriage.
- The Justice will file your marriage license with the proper officials by the 10th day of the next month.
