TO OBTAIN A MARRIAGE LICENSE
  • Both people must appear before any town clerk in Massachusetts to apply for their licenses. 
  • Both must be 18 years of age or older. A good idea to bring your birth certificates with them when applying for the license. 
  • If one or both persons are under 18, a court order will be required. 
  • A blood test is no longer required for a marriage license. 
  • It is not required for either person to be a resident of Massachusettes to apply for a  license. 
  • After the application has been made, There is a 3 day waiting period before the license can be issued. This does not, however, include the day the application is made. 
  • The Justice can not perform the ceremony without the marriage license. 
  • The couple can be married in any city or town in Massachusetts. 
  • The 3 day waiting period may be waived in certain cases of hardship, but it would require a court order of the disrtict court, probate court or family court. 
  • Following the ceremony, the Justice will provide a Marriage certificate as proof of Marriage. 
  • The Justice will file your marriage license with the proper officials by the 10th day of the next month.
